Refund Policy

1. Agreement to This Policy
By purchasing any product or engaging any service offered by Tomocreate Inc. ("we", "us", "our"), you acknowledge that you have read, understood, and agreed to this Refund Policy in its entirety. If you do not agree with any part of this policy, do not proceed with any purchase or service engagement.
Completion of a purchase or execution of a service agreement constitutes your unconditional acceptance of this policy.
2. Digital Products — No Refund Policy
All digital products offered by Tomocreate Inc., including but not limited to software applications, audio plugins, motion graphics templates, visual effects tools, and digital downloads, are provided with a free trial period prior to purchase.
It is the sole responsibility of the purchaser to evaluate the product during the free trial period, verify compatibility with their system and workflow, and confirm that the product meets their requirements before completing a purchase.
ALL SALES OF DIGITAL PRODUCTS ARE FINAL. NO REFUNDS WILL BE ISSUED UNDER ANY CIRCUMSTANCES AFTER PURCHASE IS COMPLETED.
By completing a purchase, you represent and warrant that you have tested the product during the trial period and confirmed its suitability for your intended use. Completion of purchase is deemed conclusive acknowledgment that the product functions as expected and that you have accepted these terms.
The following do not constitute grounds for a refund:
- Change of mind after purchase
- Failure to test the product during the trial period
- Incompatibility with hardware, software, or operating system configurations not verified prior to purchase
- Dissatisfaction with features, workflow, or design
- Accidental purchase
- Duplicate purchase
3. Exception — Critical Technical Defect
Notwithstanding Section 2, if a digital product is confirmed to contain a critical technical defect that is directly attributable to Tomocreate Inc. and renders the product entirely non-functional, we may, at our sole and absolute discretion, offer a replacement product or a refund.
This exception applies only where all of the following conditions are met:
- The defect is reported to us promptly after discovery
- The defect is reproducible and independently verifiable by our team
- The root cause is confirmed to lie within our product, not in the user's system configuration, third-party software, or operating environment
- We have been given a reasonable opportunity to investigate and resolve the issue
Determination of whether a defect qualifies under this exception rests entirely with Tomocreate Inc. The provision of a remedy under this exception does not establish any precedent or obligation for future cases.
4. Creative and Production Services — Cancellation Policy
The following policy applies to all video production, photography, editing, and other creative or production services provided by Tomocreate Inc.
4.1 Cancellation After Contract Execution
Upon execution of a service agreement, a cancellation fee will be assessed according to the schedule set forth in the individual contract. Cancellation fees are non-negotiable and reflect costs and scheduling commitments already incurred.
4.2 Cancellation During Production
If a service is cancelled after production work has commenced, all fees attributable to work already performed — including but not limited to pre-production, shooting, editing, and any third-party costs incurred — are non-refundable, regardless of the stage of completion at the time of cancellation.
4.3 Cancellation After Shooting or Production is Complete
Once shooting or primary production work has been completed, the full contracted fee for that phase is due and non-refundable, irrespective of whether final deliverables have been provided.
4.4 Revisions and Deliverables
Following the provision of a preliminary delivery (including but not limited to watermarked previews, online preview links, or draft files), the following terms apply:
- Revisions are limited to the number of rounds and scope of changes expressly defined in the service agreement
- Revision requests outside the agreed scope or beyond the agreed number of rounds are subject to additional fees
- Once final deliverables have been provided, no refunds will be issued for any reason whatsoever
- Exceeding the agreed revision scope or revision count does not entitle the client to a refund of any amount
5. No Chargebacks
You agree not to initiate a chargeback or payment dispute with your card issuer or payment processor in connection with any purchase from Tomocreate Inc. without first contacting us and providing a reasonable opportunity to address your concern. Any chargeback initiated in violation of this policy may result in termination of your license(s), suspension of access to our products and services, and pursuit of all available legal remedies.
6. Governing Law and Jurisdiction
This Refund Policy shall be governed by and construed in accordance with the laws of the State of New Jersey, United States, without regard to its conflict-of-law provisions. Any dispute arising under this policy shall be subject to the exclusive jurisdiction of the state and federal courts located in New Jersey.
7. Changes to This Policy
Tomocreate Inc. reserves the right to modify this Refund Policy at any time without prior notice. Changes become effective upon posting to this page. The policy in effect at the time of your purchase or service engagement governs that transaction.
